Subpoena Policy

Policy:  MissionMode does not release personally identifying information about our Customers except in limited instances related to law, security, or safety. MissionMode retains certain information such as situation logs, contact information, email, or Web/chat logs, but only for the period specified by our Customers (Retention Period).  The duration of the Retention Period for each Customer is strictly confidential, and will not be released unless Ordered by a court of competent jurisdiction.  The Retention Period may change from time to time and at any time for any particular Customer, and MissionMode will comply with its Customer instructions within reasonable business timescales.

To request Customer information from MissionMode in a civil case, you must serve MissionMode with a valid subpoena, court order, or search warrant and agree to MissionMode's terms of compensation below. MissionMode may ask for additional documentation to support requests for information.

Method of Service:  Send all subpoenas, court orders, and search warrants for Customer information only via U.S. certified mail, Airborne Express, UPS, or Federal Express to:

All other subpoenas must be served upon MissionMode's registered agent, which is on file with the Minnesota Secretary of State.  Be advised that no Customer data or equipment is maintained at the registered agent, nor the address above; NONE.  Don’t bother sending Marshals, there is nothing to seize.  Further, all Customer data is inter-mixed within our storage facilities in multiple locations in multiple states.

Procedure:  Upon receipt of a valid subpoena, court order, or search warrant, MissionMode will generally respond within 15 days.  As quickly as possible after receipt of a valid subpoena, court order, or search warrant, MissionMode will notify its Customer.  If the Customer does not object, MissionMode will comply with the valid subpoena, court order, or search warrant.  If the Customer objects, then MissionMode will wait until a final disposition is reached regarding the subpoena, court order, or search warrant before responding.  When a final disposition, including but not limited to an Order resulting from a full hearing before a court of competent jurisdiction, MissionMode will comply with the Order within 15 days.

NOTE:  Customers may archive, but cannot delete information from the MissionMode system.  Only properly authorized MissionMode personnel can delete information from the MissionMode system, and this is only done according to the confidential Retention Period.  If Ordered by a court of competent jurisdiction, MissionMode will suspend deletion of a Customer’s data for up to 360 days, beginning on the business day following receipt of the Order.  All Orders to suspend deletion must include agreement with the terms of compensation below.

Compensation:  MissionMode charges $75.00 per hour for research, $0.25 per page, and $22.00 to respond by Federal Express.  Suspension of deletion charge is $1,150 per 30 day period. Invoices should be paid within 30 days of receipt. Checks must be made out to MissionMode Subpoena Compliance.
