Privacy Policy

MissionMode Solutions, Inc. greatly respects individual privacy and is committed to its protection on behalf of all our visitors, customers, partners, and employees.  This Privacy Policy sets forth the privacy principles that MissionMode follows with respect to personal information transferred from the European Union (EU) to the United States, as well as within the United States.

Safe Harbor

The United States Department of Commerce and the European Commission have agreed on a set of data protection principles and frequently asked questions (the "Safe Harbor Principles") to enable U.S. companies to satisfy the requirement under European Union law that adequate protection be given to personal information transferred from the EU to the United States. Consistent with its commitment to protect personal privacy, MissionMode adheres to the Safe Harbor Principles. This Privacy Policy applies to all personal information received by MissionMode in the United States from the European Economic Area, in any format including electronic, paper or verbal.

Privacy Principles

The privacy principles in this Policy are based on the Safe Harbor Principles.

NOTICE: Prior to collecting any personal information, organizations subscribing to MissionMode services must sign a Software Services Agreement, which includes this Privacy Policy.  Upon doing so, each subscribing organization accepts this Privacy Policy on behalf of its members.  MissionMode only collects personal information from individuals for the use of the individual's own organization.  Each subscribing organization controls the means by which each individual member can change or correct this information, and whether the information is visible to others--in most cases, each individual can directly control the amount and the visibility of their personal information within the MissionMode system.  MISSIONMODE WILL NEVER DISCLOSE ANY PERSONAL INFORMATION TO THIRD PARTIES, or use it for any purpose without your consent.  For any inquiries or complaints regarding our Privacy Policy or our adherence to it, please contact MissionMode's Privacy Office at the address given below.

CHOICE: MissionMode will offer individuals the opportunity to choose (opt-out) whether their personal information is used to contact them for any other purpose besides their own organization's use of MissionMode's services. MissionMode only uses individuals' personal information for important MissionMode product-related announcements, and will never disclose personal information to third parties.  MissionMode does not collect any sensitive personal information (as defined by the Safe Harbor Principles).

ONWARD TRANSFER: MissionMode does not transfer personal information to third parties.  However, if it ever does so, MissionMode will obtain assurances from third parties that they will safeguard personal information consistently with this Privacy Policy.  If MissionMode were to become aware that such a third party is using or disclosing personal information in a manner contrary to this Privacy Policy, MissionMode will take reasonable steps to prevent or stop the use or disclosure.

SECURITY: MissionMode takes reasonable precautions to protect personal information in its possession from loss, misuse and unauthorized access, disclosure, alteration and destruction.  These precautions include extensive physical, network, application, and database level security measures, as well as security policies and procedures with which all MissionMode personnel must comply.  These precautions are continuously monitored and regularly reviewed in order to maintain the maximum protection of all data.

DATA INTEGRITY: MissionMode will use personal information only in ways that are compatible with the purposes for which it was collected or subsequently authorized by the individual. MissionMode will take reasonable steps to ensure that personal information is relevant to its intended use, accurate, complete, and current.

ACCESS: Each organization subscribing to MissionMode services controls the means by which each individual member can change or correct their personal information, and whether the information is visible to others--in most cases, each individual can directly control the amount and the visibility of their personal information within the MissionMode system.

ENFORCEMENT: MissionMode will conduct compliance audits of its relevant privacy practices to verify adherence to this Policy. MissionMode employees are educated about our Privacy Policy, and any employee that MissionMode determines is in violation of this Policy will be subject to disciplinary action up to and including termination of employment.

DISPUTE RESOLUTION: Any questions or concerns regarding the use or disclosure of personal information should be directed to MissionMode's Privacy Office at the address given below. MissionMode will investigate and attempt to resolve complaints and disputes regarding use and disclosure of personal information in accordance with the principles contained in this Policy. Any controversy or claim arising out of or relating to this Policy shall be determined by arbitration administered by the American Arbitration Association under its International Arbitration Rules, or by the EU Data Protection Authorities.

LIMITATION ON APPLICATION OF PRINCIPLES: Adherence by MissionMode to these Safe Harbor Principles may be limited (a) to the extent required to respond to a legal or ethical obligation; and (b) to the extent expressly permitted by an applicable law, rule or regulation.

CHANGES TO THIS SAFE HARBOR PRIVACY POLICY: This Policy may be amended from time to time, consistent with the requirements of the Safe Harbor Principles. A notice will be posted on MissionMode's web page at www.missionmode.com.
